本條款規範您使用 SpeakRight 及相關功能時，您與 Floatingland 之間的權利義務關係。SpeakRight 提供 AI 發音練習、情境對話、學習紀錄與部分付費功能。

1. 服務提供者與適用範圍
SpeakRight 由 Floatingland 提供與營運。本條款適用於您對 SpeakRight App、相關網站頁面、訂閱權益、學習內容與支援服務的使用。
2. 服務內容
SpeakRight 提供的功能可能包括匿名或註冊登入、情境對話練習、錄音與發音分析、文字修正、AI 回覆、學習紀錄、付費去廣告、付費專屬練習功能，以及與此相關的更新、測試或備援功能。我們可能隨時調整、限制、修改或下架部分功能。
3. 使用資格與帳號
- 您應具備依適用法律使用本服務的能力；若您為未成年人，應取得法定代理人同意。
- 您可以先以匿名方式使用部分功能，之後再綁定或轉換為 Email、Google 或 Apple 帳號。
- 您應提供真實且可使用的帳號資訊，並自行保管登入方式與裝置安全。
- 您不得冒用他人身分、未經授權存取他人帳號，或以任何方式干擾認證與帳號機制。
4. 可接受使用規範
- 不得將本服務用於任何違法、侵權、騷擾、詐騙、仇恨、暴力、濫發或其他不當目的。
- 不得輸入、上傳或散布您無權使用的內容，或侵犯第三人隱私、智慧財產權或其他權利的內容。
- 不得以自動化、爬蟲、批次腳本、逆向工程、破解、壓力測試或類似方式干擾、探測或濫用本服務。
- 不得利用本服務建立競品資料集、訓練外部模型，或繞過付費、配額、廣告與使用限制機制。
5. 使用者內容與授權
您對自己提交的文字、錄音、練習輸入與其他內容，仍保有您依法享有的權利。但為了提供、維護、改善與保護 SpeakRight，您同意授權 Floatingland 及其服務供應商在必要範圍內儲存、處理、傳輸、分析、重製與顯示該等內容。
6. 訂閱、付款與平台規則
- 部分功能可能需付費訂閱或一次性購買後才能使用。
- 若您透過 Apple App Store 或 Google Play 訂閱，費用、續訂、取消、退款與恢復購買均受各平台規則約束。
- 除法律另有規定或平台另有處理外，已支付費用通常不予退還。
- 我們可依產品策略調整價格、功能範圍、免費額度或廣告顯示方式。
7. 智慧財產權
SpeakRight 的軟體、介面、設計、文字、圖像、模型整合方式、商標與其他內容，除使用者依法享有的內容外，均由 Floatingland 或其授權人保有權利。未經授權，您不得複製、散布、出售、出租、再授權或改作。
8. 服務可用性與免責聲明
本服務係依「現況」與「可用性」提供。語音辨識、發音評分、翻譯、AI 回覆與學習建議可能不完整、不精確或不適合特定用途。您理解並同意，SpeakRight 屬輔助學習工具，不構成專業教育、醫療、法律或其他專業意見。
9. 責任限制
於適用法律允許的最大範圍內，Floatingland 不對任何間接、附帶、特殊、懲罰性或衍生性損害負責，也不對資料遺失、營業中斷、學習成果不如預期或第三方平台問題所致損失負責。若法律不允許完全排除責任，我們的總責任以上一個月內您就 SpeakRight 實際支付的金額，或新台幣 1,000 元，以較高者為上限。
10. 暫停與終止
若您違反本條款、濫用服務、造成風險，或基於安全、法令遵循、營運調整需要，我們得限制、暫停或終止您對全部或部分服務的存取。您也可隨時停止使用本服務。
11. 準據法與爭議處理
本條款以中華民國（台灣）法律為準據法，不適用其涉外法律衝突原則。因本條款或本服務所生爭議，雙方應先本於誠信協商處理；如仍有爭議，以台灣台北地方法院為第一審管轄法院，但適用法律另有強制規定者除外。
12. 條款更新與語言
我們可能不時更新本條款，更新後版本將公布於本頁。若中文與英文版本有歧義，以中文版本為優先參考。若您在更新後繼續使用本服務，視為同意更新內容。聯絡信箱：omurok@gmail.com。

1. Provider and Scope
SpeakRight is provided and operated by Floatingland. These Terms apply to your use of the SpeakRight app, related website pages, subscription benefits, learning content, and support services.
2. Description of the Service
SpeakRight may include anonymous or registered sign-in, scenario-based conversation practice, recording and pronunciation analysis, text correction, AI-generated replies, learning history, paid ad removal, paid premium practice features, and related updates, testing, or fallback functionality. We may modify, limit, suspend, or discontinue any feature at any time.
3. Eligibility and Accounts
- You must have the legal capacity required to use the service. If you are a minor, you must have consent from a parent or legal guardian.
- You may begin with an anonymous account and later link or convert it to an email, Google, or Apple account.
- You must provide accurate and usable account information and are responsible for your login methods and device security.
- You may not impersonate another person, access another account without authorization, or interfere with authentication or account systems.
4. Acceptable Use
- You may not use the service for unlawful, infringing, abusive, harassing, fraudulent, hateful, violent, spammy, or otherwise improper purposes.
- You may not upload, input, or distribute content you do not have the right to use, or content that violates privacy, intellectual property, or other rights of third parties.
- You may not use bots, crawlers, scripts, reverse engineering, circumvention, load testing, or similar methods to probe, interfere with, or abuse the service.
- You may not use the service to build competing datasets, train external models, or bypass payment, quota, advertising, or usage restrictions.
5. User Content and License
You retain any rights you may have in the text, recordings, learning inputs, and other content you submit. However, to operate, maintain, improve, and protect SpeakRight, you grant Floatingland and its service providers a limited license to store, process, transmit, analyze, reproduce, and display that content as necessary for the service.
6. Subscriptions, Billing, and Platform Rules
- Some features may require a paid subscription or one-time purchase.
- If you subscribe through Apple App Store or Google Play, billing, renewals, cancellations, refunds, and restore purchases are governed by that platform's rules.
- Except where required by law or handled by the platform, fees already paid are generally non-refundable.
- We may change pricing, feature scope, free allowances, or advertising behavior as part of product updates.
7. Intellectual Property
Except for rights you retain in your own content, the software, interface, design, text, graphics, integrated model workflows, trademarks, and other elements of SpeakRight are owned by Floatingland or its licensors. You may not copy, distribute, sell, rent, sublicense, or create derivative works from them without authorization.
8. Availability and Disclaimer
The service is provided on an "as is" and "as available" basis. Speech recognition, pronunciation scoring, translation, AI responses, and learning suggestions may be incomplete, inaccurate, or unsuitable for a particular purpose. SpeakRight is a supplemental learning tool and does not constitute professional educational, medical, legal, or other professional advice.
9. Limitation of Liability
To the maximum extent permitted by law, Floatingland is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, business interruption, unsatisfactory learning outcomes, or issues caused by third-party platforms. Where a complete exclusion is not permitted, our total liability will not exceed the greater of the amount you paid for SpeakRight in the previous one month or NTD 1,000.
10. Suspension and Termination
We may restrict, suspend, or terminate access to all or part of the service if you violate these Terms, misuse the service, create risk, or where necessary for security, legal compliance, or operational reasons. You may stop using the service at any time.
11. Governing Law and Disputes
These Terms are governed by the laws of Taiwan, excluding conflict-of-law rules. The parties will first attempt to resolve disputes in good faith. If a dispute remains unresolved, the Taipei District Court in Taiwan will have jurisdiction as the court of first instance, unless applicable law requires otherwise.
12. Updates and Language
We may update these Terms from time to time, and the latest version will be posted on this page. If there is any inconsistency between the Chinese and English versions, the Chinese version will prevail for reference.
